AN ORDINANCE

Authorizing the Director of Public Service and Safety to advertise for bids for materials and services to implement the City’s Sidewalk Improvement Project in accordance with specifications now on file and available public review and inspection in the office of the Director, to contract with the lowest and best bidder only, and to request funding for the Sidewalk Improvement Project from the Community Development Block Grant, and declaring an emergency to exist.

    WHEREAS, the City of Fostoria, Ohio has determined to proceed with the improvement of public sidewalks through a Sidewalk Improvement Project; and,
   
    WHEREAS, pursuant to Article 5.04 of the Charter of the City of Fostoria, Ohio and Section 145.05 of the Codified Ordinances of the City of Fostoria, Ohio it is the duty of the Director of Public Service and Safety to advertise for bids for materials and services, and enter into a contract with the lowest and best bidder to complete the Sidewalk Improvement Project according to specifications on file in the Director’s office and now currently available for public inspection and review, which is anticipated to exceed a cost of twenty-five thousand dollars ($25,000.00).

    WHEREAS, funding is now available for the Sidewalk Improvement Project through the Community Development Block Grant, available through the Office of Housing and Community Partnerships, State of Ohio, number A-F-09-2BN-1.

    NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Fostoria, Counties of Seneca, Hancock and Wood, State of Ohio.

      SECTION 1.    The Director of Public Service and Safety is authorized to advertise for bids for materials and services pursuant to Section 145.05 of the Codified Ordinances of the City of Fostoria, Ohio to implement the City’s Sidewalk Improvement Project according to specifications now on file in his office, and to accept a bid from the lowest and best bidder for those services and materials.

      SECTION 2.    The Director of Public Service and Safety is authorized to apply for funding for this project from the Community Development Block Grant Formula Program, Grant No. A-F-09-2BN-1 from the Office of Housing and Community Partnerships, State of Ohio.

      SECTION 3.    It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal actions were in meetings open to the public, and in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
     
      SECTION 4.  This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of public health, safety, and welfare.  The reason for such emergency lies in the fact that the project should be completed during the current construction season.

      THEREFORE, upon the affirmative vote of two-thirds (2/3) of all members elected to Council, and signature by the Mayor, this ordinance shall go into immediate force and effect.

MEETING OF THE FOSTORIA CITY COUNCIL HELD (TUESDAY)
AUGUST 17, 2010 AT 7:30 O’CLOCK P.M.

Council President Joe Droll called the regular meeting to order at 7:30 p.m.

Invocation by Reverend Paul Myers of Grace United Church of Christ.
 
Allegiance was pledged to the Flag.

Roll call of councilpersons showed seven (7) councilpersons present.   It was moved by Councilperson Lake and seconded by Councilperson Widmer to approve the minutes of the regular meeting of August 3, 2010, passed by seven (7) votes.  The minutes of the regular meeting of August 3, 2010, were approved.
    
COMMUNICATIONS

REPORT OF COMMITTEES

A.    FINANCE COMMITTEE:

Councilperson Marley reported the following for the committee which met from 4:00 p.m. to                                                       
4:21 p.m. on Monday August 16, 2010:

See Finance Committee Minutes of August 16, 2010 attached hereto and made a part hereof of these minutes.

Councilperson Marley noted the next finance meeting will be September 6, 2010 at 4:00 p.m. in the conference room.

B.    PUBLIC AFFAIRS COMMITTEE:

C.      LAW AND ORDINANCE COMMITTEE:

REPORT OF OFFICERS

A.    MAYOR:
   
1. The Mayor said Carl Cherry long time member of the planning commission is stepping down. Mayor Davoli said the administration is looking for someone to replace him. He thanked Mr. Cherry for his years of service.

2. The Mayor said the city received a letter from the ODOD about our CHIP Grant which is $500,000.00 He said this grant is to fix up houses that are in need of repair. Mayor Davoli said we also garnered a grant for $22,000.00 for Habitat for Humanity.

3. Mayor Davoli said we are narrowing the field for a new zoning inspector, he said we hope to have someone soon.

4. The Halloween Parade will step off at 4:00 p.m. October 31st with trick or treat to follow the same evening at 6:00 p.m. for one hour.

5. The swearing in for Keith Loreno our new Fire Chief will take place August 23rd at 11:00 a.m. There will be a meet and greet before the swearing in at 10:30 a.m. Mayor Davoli encouraged everyone to stop out and meet the new chief.

6. Mayor Davoli reminded everyone that school is starting this week and that the police will be patrolling the school zones more to remind people to drive extra cautious. He also noted our new superintendent of schools was in attendance at this evenings meeting

B.    SAFETY-SERVICE DIRECTOR:

    Dennis Fligor, Safety-Service Director

1. Mr Fligor said he has been receiving calls from citizens asking what we were going to do about natural gas rates for the city. He said we usually hear from AMP Ohio in late September or early October as to what the gas rate will be starting in January. He said once we hear from them we will give the residences participating in the program the opportunity to opt out.

2. Mr. Fligor said the pool closed August 15th and we will have a financial report soon. He noted once the report is available he will make a recommendation to Council for next years plans.

3. Mr. Fligor requested an executive session do discuss personnel after the regular meeting.


C.    LAW DIRECTOR:

       Tim Hoover, Law Director
      
1. Mr. Hoover said the issue about a hotel on State Route 12 not paying bed tax came up at the finance meeting yesterday and he wanted to address the situation with all members of council this evening. Mr. Hoover said the business has not paid taxes since 2007 and also owed Hancock County back taxes. If any back taxes are ever collected Hancock County is first in line over the City of Fostoria. The business was owned by a corporation and the city began to peruse the agent of that corporation. We located a person in Michigan that we believed to be the owner and issued a summons for him to appear in Fostoria Municipal Court. This person did not appear and a warrant was issued for his arrest.  In the meantime the establishment was sold at sheriff’s auction in 2009 and in October of 2009 a new corporation was formed. Mr. Hoover said he drove through the parking lot of the motel last night and saw people going into rooms carrying suit cases which led him to believe they were open. He said he has informed the statuary agent of this business that they are responsible for paying a bed tax for moneys collected since November of 2009 when the business was established. Mr. Hoover said he will continue to peruse the matter.

2. Mr. Hoover said he is submitting legislation for an alley vacation and an ordinance that changes the traffic control map for various streets throughout the city this evening
      
D.    CITY ENGINEER:

       Dan Thornton, City Engineer

1. Mr. Thornton said he received a request from St Wendelin High School to chain off the drive directly behind the high school during certain hours of the day. Mr. Thornton said the school actually owns the drive and can do what ever they want without having to ask permission

E.    DIRECTOR OF FINANCE:

 F.    PUBLIC:
  
Dave Ringman 627 N. Vine Street thanked council members for attending the zoning board meeting this evening, and supporting his position to not allow a variance for his neighbor to build a garage. Mr. Ringman issued a complaint against then acting Zoning Inspector Jason Wickard for injecting his personal opinion to the zoning board and supporting the propose variance. He said the remarks Mr. Wickard made were unnecessary and if Mr. Wickard knew the zoning code better he would not have recommended the proposed variance. Mr. Ringman said Mr. Wickard should have handled the situation with a higher degree of professionalism.

Janice Hanes 330 Star Avenue asked to have the bushes trimmed along the west side of her street. She also commented on the gas aggregation program saying it would be better if the commitment was only 6 months and not 1 year. Ms. Hanes asked what the procedures were to have a house condemned and Mayor Davoli said he would provide her with that information.

Warren Digby 424 West Center Street a Lieutenant for the Fostoria Fire Department and a member of local 325 said he did not think the public was aware of the manpower issues at the fire department. Mr. Digby gave several scenarios of delayed responses by the fire department and the EMS. He said the situation is abominable and people have died due to the lack of manpower. Safety Service Director Fligor asked Mr. Digby to provide the name of the person that died. Mr. Digby said he could not give out the name of a patient. Mr. Digby said, it is his opinion they could have done more for this individual if the department had more manpower. He said most people think their contract has been settled and it has not. He said the city changed the department’s health care without telling the members. Mr Digby said the department is trying hard to make changes so they can keep people working and he is being told this is just business and nothing personal. He said he is having a hard time feeling it is not personal.

MISCELLANEOUS BUSINESS:

Council President Droll said attended the prayer meeting at the Good Shepherd Home and was very pleased with what he saw. He said the prayer meetings are held the 3rd Monday of every month and a larger event is being planned for October. Council President Droll urged everyone to attend.

Mayor Davoli said the administration is looking to have trick or treat and the Halloween Parade on Sunday October 31st . The parade would start at 4:00 p.m. and trick or treat would start at 6:00 p.m. for one hour.

EXECUTIVE SESSION:

It was moved by Councilperson Lake second by Councilperson Marley to move into executive session to discuss personnel with no business to follow, passed by seven (7) votes. Council moved into executive session at 8:20 p.m.

It was moved by Councilperson Feasel second by Councilperson Bettenhausen to come out of executive session, passed by seven (7) votes. Council came out of executive session at 9:13 p.m.

ADJOURNMENT:

It was moved by Councilperson Marley and seconded by Councilperson Widmer to adjourn; passed by seven (7) votes. Council adjourned at 9:14 p.m.
